O autor, instituição de previdência social com sede à Rua do México, 128, cidade do Rio de Janeiro, alegou que em 24/1/1946 deu em locação ao suplicado o apartamento na Rua André Azevedo, 101, estação de Olaria. O locatório deveria pagar o aluguel até o quinto dia útil ao mês subsequente ao vencido, mas deixou de pagá-lo desde julho de 1948. O autor pediu então o despejo do suplicado. A ação foi arquivada.
