A autora alugou, a título precatório, o próprio nacional situado na Rua Doutor Carlos Seidl, 349, casa I ao réu pelo aluguel mensal no valor de 70$000. Aconteceu que o réu não estava pagando os devidos aluguéis há 19 meses. Fundamentada no Decreto nº 3084 de 1898, artigo 422, a autora requereu um mandado executivo a fim de haver o pagamento, sob pena de penhora dos bens. O juiz deferiu o requerido.
