O autor era 1º Tenente da reserva remunerada do Exército Nacional e pediu sua promoção militar com todas as vantagens e vencimentos integrais. Tal direito viria tanto de sua atuação em tempo de guerra na zona de guerra da 2ª Guerra mundial guarnição da vila militar, e pelo combate ao comunismo na Intentona Comunista de 1935. A ação foi julgada improcedente.
