Os réus contestaram o testamento de Gabrielle Brune Seiler, alegando insanidade mental. Os bens de herança teriam sido destinados a hospícios, casas de correção em São Paulo, Rio de Janeiro, Buenos Aires,Manchester, Londres, Paris, Genebra, Roma, Veneza. Disseram ter sofrido crimes políticos por banqueiros alemães e políticos brasileiros, envolvendo questões correlatas a 2ª Guerra Mundial, segredos de guerra e armistício, deixando como testamenteiro o Tribunal de Justiça Internacional de Haya. Trata-se de embargos. O Tribunal Federal de Recursos rejeitou os embargos oferecidos pelos autores. Estes recorreram extraordinariamente e o Supremo Tribunal Federal não conheceu do recurso. Código Civil, artigos 1627, 1744, 1027, 1725; Lei nº 23 de 1947, artigo 6; Constituição Federal, artigo 101.
