O autor requereu a arrecadação dos bens de José Esteves, nacionalidade portuguesa, falecido sem testamento e sem herdeiros. Trata-se de homologação de sentença estrangeira, na qual se ratifica a carta rogatória, ou seja, a internalização desta sentença a fim de posteriormente esta ser executada. Tal fato ocorre ao ser constatado herdeiro. Já o Ab intestato (pessoa que falece sem deixar herdeiro e testamento - Plácido e Silva. Dicionário Jurídico) tem seus bens requeridos pelo consulado respectivo a seu país, podendo haver disputa do espólio entre os países envolvidos. Procuração, 1904.
