O suplicante, por meio do Procurador da República Manoel A. Buzaglo, ofereceu denúncia contra o suplicado, alegando que este, na qualidade de diretor superintendente da firma M. Duarte instalou e utilizou equipamento de telecomunicações constituído de transmissor e alta freqüência sem autorização prévia do Conselho Nacional de Telecomunicações. A ação foi julgada improcedente. decreto-lei 236, de 28/02/1967, artigo 70; código penal, artigo 6 .
