A suplicante, firma comercial sediada na Avenida Rio Branco, 51, Rio de Janeiro, requereu ação para anulação da cobrança indevida no Inspetor da Alfândega do Rio de Janeiro sobre vidros importados do Japão que deveriam ser taxados na tarifa mínima como determina a Lei nº 313 de 30/07/1948. O juiz julgou a ação procedente. O Tribunal Federal de Recursos negou provimento ao recurso proposto pela ré. A União, então, propôs agravo de instrumento que foi negado pelo Supremo Tribunal Federal.
