O autor era militar e alegou que não podia pedir sua reforma por se tratar de algo ex-ofício. Como desde 08/08/1962 estava afastado para tratamento de saúde por tuberculose, pediu reforma no posto pela Lei da Inatividade, com promoção a 3º Sargento pela Lei nº 3067 de 22/07/1956. A ação foi julgada improcedente. O autor apelou e a apelação foi julgada deserta.
