O autor, oficial da Fazenda foi demitido sem aviso no dia 14 de junho de 1890, fundamentado em atos praticados quando embarcado no cruzados Liberdade. Afirmando não ser acusado a interrogado pelo conselho de Investigação, nem a respeito da demissão, sendo isso ilegal, inicia uma ação contra a União. O juiz julgou procedente o pedido para anular o ato e condenar a Fazenda a pagar ao autor seus vencimentos integrais.
