Trata-se de parte de um processo a fim de cobrar pela omissão de descarga, diferença de volume e o direito de indenização, fundamentada na Nova Consolidação das Leis das Alfândegas, artigo 667. O juiz julgou prescrito o direito da Fazenda Nacional, com recurso de ofício. A ré agravou, mas o Supremo Tribunal Federal negou provimento ao agravo. A ré ofereceu embargos, que foram rejeitados. decreto 5449 de 1928, Código Civil, artigo 177.
