A autora denunciou o réu como incurso no Código Penal arts 356 e 358. Ele fora preso em flagrante quando, acompanhado por outro indivíduo, foi visto quebrando uma janela do stand do Arsenal de Guerra e entrando no edifício para roubar. O réu era natural do Espirito Santo. O réu foi absolvido. A Procuradoria da República recorreu ao Supremo Tribunal Federal, que negou-lhe provimento.
