O acusado, estado civil casado com 38 anos de idade de nacionalidade argentina, natural de Buenos Aires, foi expulso do Brasil por não exercer atividade lícita no país, pela portaria de 04 de agosto de 1928 do Ministério da Justiça e Negócios Interiores. Contudo, reingressou no território nacional sem ter sido revogada a portaria de expulsão. O réu foi preso preventivamente, após isso foi julgada improcedente a denúncia, sendo expedido alvará de soltura a favor do réu. Decreto nº 4247 de 06/01/1921, artigo 6; Código Penal, artigo 406.
