O impetrante requereu ordem de habeas corpus preventivo aos cidadãos brasileiros que se achavam ameaçados na liberdade pessoal pelo sorteio militar anunciado no edital da Capitania do Porto, a fim de preencherem as fileiras da Armada Nacional. Todos os pacientes eram foguistas de diversas lanchas, navios e embarcações da marinha mercante nacional. Foram citadas as Constituição Federal, artigo 86, Código Penal, Código Penal da Armada e Lei nº 2556 de 26/09/1874, artigo 97, da marinha. Pedido procedente. Recorte de Jornal Diário Oficial, 24/07/1903 e 03/01/1904, Jornal do Brasil, 22/11/1903.
