A autora havia alugado ao réu o imóvel de sua propriedade, localizado à Estrada do Norte 32, pelo valor mensal de 160$000 réis. O réu, porém, encontrava-se em dívida com os aluguéis no valor de 880$000 réis. A suplicante requereu, conforme o Decreto n° 3084 de 1898 artigo 422, a expedição de um mandado executivo, a fim de obter o pagamento da dívida, sob pena de penhora.
