A Fazenda Nacional havia movido um processo de execução fiscal contra o autor capitão do navio Capitão Roca, que, posteriormente, apelou contra a sentença deferida pelo tribunal, através de uma petição de agravo contra a Fazenda Nacional. A referida petição foi indeferida, não permitindo, consequentemente, defesa prévia. Devido a esse fato, o autor faz uso de carta testemunhável. É citado o Lei n° 221 de 20/11/1894 artigo 69.
