Foi alegado que tal invento não ofereceria resultado prático industrial e tampouco constituiria invenção de algo novo. São citados os seguintes dispositivos legais: Decreto de 15/07/1915, Lei nº 3129 de 1882, Decreto nº 8820 de 1882, Lei nº 3129, artigo 3, Regulamento 8829 de 1882, artigos 44 e 52 e Decreto nº 8136 de 1910, artigo 1 .
