O autor era arrendatário dos terrenos da Fazenda Nacional em Santa Cruz Rio de Janeiro. Desde 1905, o réu captava água e desviava cachoeiras e rios para aumentar o volume de água do Ribeirão das Lages, afluente do Rio Guandú. Com isso, as terras do suplicante corriam o risco de serem inundadas, causando danos materiais ao autor .
