O processo se inicia após inquérito policial sobre cédula falsa na Delegacia do 12º Distrito Policial. O reclamante foi Hermegildo Costal, residente à Rua do Resende, 666, e Carlos Fernandes Espínola, Rua Senador Euzébio, 352, e declararam ser suas a cédula do valor de 500$000 réis. A suplicada era a sua estado civil amante e, sem seu consentimento, ordena trocar a nota falsa. Também foi acusada a ré. O juiz concordou com o pedido de arquivamento dos autos feito pela Procuradoria Criminal da República, por não ter havido dolo e intenção.
